Silverback Contracts · Divorce settlement agreement

Your divorce settlement, read before you sign it.

The settlement decides money, the house and retirement for years after the divorce is final. Most of what goes wrong later was sitting in one paragraph nobody slowed down on.

What people miss

Three clauses to check before you sign

Retirement accounts split on paper only

A 401(k) or pension usually needs its own court order (a QDRO, the form the plan administrator requires) to move money. If the agreement says "divided equally" and nobody files that order, the money can stay in the other name.

The house without a refinance deadline

Signing the deed over does not take your name off the mortgage. Look for a date the other side must refinance or sell, and what happens if they miss it.

Support that ends on the wrong event

Spousal support often stops on remarriage, cohabitation, a set date or a retirement age. Each one is a sentence. Know which sentence you are agreeing to.
